Three systems decide it

Nonresidential compliance turns on whether a project touches lighting, mechanical equipment, or the envelope — walls, roof, glazing and insulation. If it touches any of them, documentation is required. If it touches none of them, it generally is not.

That framing is more useful than asking whether the building is "new" or "existing", because most commercial work is neither a new building nor a cosmetic refresh. It is a change to one or two systems inside a building that carries on operating.

Scope follows the area being altered

A tenant improvement is assessed on the space being worked on. Fitting out one floor of a six-floor building brings that floor into scope; the other five are not dragged in because of it. This is the single most reassuring thing for an owner to understand, because the instinctive fear is that a modest fit-out triggers a whole-building upgrade. It does not.

What stays outside

Genuinely cosmetic work. New paint, floor coverings, furniture, signage and finishes that leave the lighting, mechanical systems and envelope alone are not regulated by the energy code. Replacing a light fitting like for like is a grey area worth checking; redesigning a lighting layout is not — that is in scope.

Change of use is its own case

Converting a space from one occupancy to another — retail to restaurant, warehouse to office — almost always brings lighting and mechanical work with it, and the requirements that apply follow the new use rather than the old one. A space that was compliant as a shop is not automatically compliant as a kitchen.
